Disclaimers & Disclosures Policy 

  • Safe Pakistan Welfare Trust (SPWT) is a Government Registered Tax-Exempt Non-Profit Organization.
  • It’s important to understand the limitations of the Platform before using it, with special reference to the background check being conducted and displayed on this platform:
    • The system does NOT perform a NADRA verification. Hence, it is very important for the Employers to first authenticate the worker’s CNIC information being submitted of their workers into the Platform using NADRA SMS 7000 service. (https://www.nadra.gov.pk/local-projects/identity-management/sms-services-7000-8400-8300-8500/)
      • This step is very important to check against FAKE CNIC numbers. Workers sometimes hide their true identity.
      • The Employers are required to first check the authenticity of the CNIC data by transmitting through text message the CNIC number of the workers to 7000 SMS NADRA SERVICE. Standard SMS charges will apply.
      • NADRA will transmit back the name against the CNIC number as well as the person’s father’s name. This step will ensure that the Employer is submitting the correct CNIC number of the person they are hiring. (https://www.nadra.gov.pk/local-projects/identity-management/sms-services-7000-8400-8300-8500/)
    • This platform will transmit the NADRA issued CNIC information to Police and Citizens Police Liaison Committee (CPLC).
    • The Tasdeeq platform is connected to Police through a live API connection. Police are solely responsible for the authenticity of the data. The information being relayed & displayed through the Tasdeeq platform with regards to the criminal background check is being displayed at the Tasdeeq end without any human intervention.
    • The Citizens Police Liaison Committee (CPLC) maintains the digitalized FIRs information that has been filed with Police stations since 1987 (http://www.cplc.org.pk/2015/11/04/fir-database).
    • Employers need to ensure that they obtain either written or video consent of their workers before submitting their CNIC for background criminal check.
    • Police FIRs filed all over Pakistan has its inherent limitations, such as (a) CNIC may not be mentioned in some FIRs, (b) Some FIRs may only have first name or name entered with different spellings, (c) FIRs are mostly filed in Urdu or local vernacular language, (d) Some FIRs may have been filed against “unknown people”.
    • In other words, a person may have an FIR filed against him/her but if a CNIC may not be mentioned on that FIR, he/she may evade detection. The same may be true in terms of spelling of the name, maybe different in Urdu to English. An example is “Mohammad” vs “Muhammad”, “Ahmad” vs “Ahmed”, etc.
    • Simply filing an FIR against a person does not mean a criminal activity or that a person may be a criminal. A crime is only confirmed against any person by a Court of Law upon conviction at the end of a trial.
    • Furthermore, the information is entered in the platform (web interface) is a manual process. Hence, the displayed information is subject to human errors at the data entry level.
    • Tasdeeq is not responsible for any background information. It is only a conduit.
  1. Data We Collect

Tasdeeq collects the information you provide directly to us, such as when you create or modify your account, request on-demand services, contact customer support, or otherwise communicate with Tasdeeq. This information may include name, father/husband name, identification card number & photos, nationality, address, facial image, contact number, mobile number, gender, date of birth, device permission, email address and your profession (“Personal Data” or “Personal Information”).

The provision of your Personal Data is voluntary. However, if you do not provide Tasdeeq with your Personal Data, Tasdeeq will not be able to process your Personal Data for the purposes outlined below.

If you are a user, household employer, business owner, corporate representative, business, worker or job searching worker, provision of your Personal Data is mandatory and failure to provide your Personal Data, may be a breach of laws or regulatory requirements and may cause Tasdeeq to be unable to engage you to provide services or products.

When you use the Tasdeeq Services. Tasdeeq may collect information about you in relation to your location information (your geo-coordinates while the Tasdeeq Application is being used or not), Contacts Information, usage and preference information (information about how you and site visitors interact with Tasdeeq Services, settings chosen, electronic device information (Attributes such as operating system, hardware version, device settings, file and software names and types, battery and signal strength, and device identifier), SMS data (the date and time of the call or SMS message, the parties phone numbers, and the content of the SMS message), log information (including server logs, which may include information like device IP address, access dates and times, app features or pages viewed, app crashes and other system activity, type of browser, and the third-party site or service).

The following Privacy Policy explains how we collect, use, transfer, disclose and protect your personally identifiable information obtained through our Application. Please review it carefully to make sure you understand our privacy practices.

Personal Data: Your demographic and other personally identifiable information (such as your name and email address) that you voluntarily give to us when choosing to participate in various activities related to the Application, such as verifying a worker, mini signup, complete/create profile, searching for jobs, searching for workers, creation of jobs, hiring a worker, identity verification, customer support, or in our forums, liking posts, sending feedback, and responding to surveys. All data you disclose in these areas will be accessible to the owners of the Application.

Derivative Data: The information our servers automatically collect when you access the Application, such as your native actions that are integral to the Application, other interactions with the Application and other users via server log files.

Financial Data: Financial information, such as data related to your payment method for invoice submission, what user needed when the units of verifications exceeds (e.g. account name, account number, bank name, branch, data, amount, etc), We maintain the record of users who bought the verification units. This is the financial information that we collect.

Geo-Location Information: We may request access or permission to track location-based information from your mobile device, either continuously or while you are using the Application, to provide location-based services. If you wish to change your access or permissions, you may do so through your device’s settings.

Mobile Device Access: We may request access or permission to certain features from your mobile device, including your mobile device’s camera, microphone, speaker, and GPS. If you wish to change your access or permissions, you may do so through your device’s settings.

Mobile Device Data: Device information such as the mobile device ID number, model, manufacturer, version of the operating system, phone number, country, location, preferred language, and any other data you choose to provide.

Push Notifications: We may request to send you Push-notifications regarding your account or the Application. If you wish to opt out of receiving these types of communications, you may turn them off through your device’s settings.

Data From Contests, Giveaways, and Surveys: Personal and other information you may provide when entering contests or giveaways and/or responding to surveys.

  1. Using the Data We Collect

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the application to:

  • Create and manage your account.
  • Fulfill and manage account/profile, settings, Tasdeeq’s modules and other using application.
  • Communicate with you regarding your account, verification units, or services opted for.
  • Enable user-to-business communications.
  • Administer promotions, sweepstakes, and contests.
  • Compile anonymous statistical data and analysis for use internally or with third parties.
  • Generate a personal profile about you to make future visits to the Application more personalized.
  • Increase the efficiency and operation of the Application.
  • Monitor and analyze usage and trends to improve your experience with the Application.
  • Notify you of the updates to the Application.
  • Offer new products, services, features, and/or recommendations.
  • Perform other business activities as needed.
  • Prevent fraudulent, monitor against crime, and protect against criminal activity.
  • Request feedback and contact you about your use of the Application.
  • Resolve disputes and troubleshoot problems.
  • Respond to product and customer service requests.
  • Show you the jobs based on your chosen professions and location
  • Show you the professionals, workers who registered themselves to hire and avail the services workers are offering.
  • Show the work history, rating and feedback you received as a worker from past employers.
  • Show the chosen professions, name, phone number where the employer can contact the worker and other information etc.
  • Solicit support for the Application.
  • Assist local law enforcement organizations in contingencies or accidents or criminal activities.
  1. Sharing the Data We Collect

We will share such information as your name, phone number, location (area, city, province), geo-location, cnic details, Police Station with the law and enforcement agencies. This information is required for the Law and Enforcement agencies to mark and identify the individual workers and to mark workers CPLC requires the employer’s details. The sharing of details with law and enforcement agencies is to make our application and whole system verified when our application user wants to interact with another user of the application like (searching for job using nokri, searching for workers, hiring of workers using nokri)

We also share the phone number, name, professions, picture, city, rating, feedback, reviews of the user in search workers feature available for application users who wanted to hire workers.

On job posting, the user’s name, and job details (professional required, salary, location, description, audio) will be shared with the users who are looking for jobs/work. The job details sharing criteria is based on the profession selected of the user who is looking for a job/work.

The user receives feedback/comments, reviews and star rating will be shared with the employers after the user’s permission by accepting our terms and conditions of the user and the employers are able to provide the dbacks/comments, reviews and star rating.

We may work with third-party organizations and people to facilitate or provide the Application and specific services on our behalf, to offer customer support, to give our service providers geolocation data, to carry out website-related tasks (such as, but not limited to, maintenance work, database management, web analytics, and feature enhancement), to help us understand how our Service is used, or to work with our professional advisors and other external parties. These third parties are contractually restricted from using or disclosing your personal information for any other reason and only have access to it as necessary to carry out these tasks on our behalf.

Without your consent, we only divulge your Personal Information to the appropriate Law and enforcement agencies, employers (information shared as a worker), and in the event of a legal action or dispute of any kind involving the Services between you and us, or between you and other users, or in the event of an emergency involving your health and/or safety, we will divulge your Personal Information to the extent that is legally required.

Worker/tenant verification and registration: Workers sometimes use fake CNIC number & name to hide their true identity & criminal intent. Tasdeeq’s module Tasdeeq does not perform NADRA verification, only a criminal background match is carried out against a given CNIC number. Employers/owners/land-lords/contact persons need to verify the worker’s CNIC details by using NADRA SMS 7000 service. Kindly send the worker CNIC number on (NADRA SMS 700). NADRA matches these on the CNIC provided by the worker. This step will ensure that you are performing the criminal check on the correct CNIC and not a fake CNIC

Advertising, measurement and analytics services (not personally identifiable information only: We want our advertising to be as relevant and interesting as any other information you may have on our services. With that in mind, we use all the information we have about you to show you relevant ads. We do not share information with advertising, measurement or analytics partners that identifies you personally (personally identifiable information such as name or email address), which can be used to contact you personally or identify you individually). We may provide these partners with information about their advertising access and effectiveness without providing personally identifiable information, though we will NOT collect information in order to personally identify you.

Provide, improve and promote services: We review and research products and services to improve and enhance them, develop new products and features, test developing features, and analyze the information we have, and audit and troubleshoot. Perform activities.

Talk to you: We use your information to send you marketing communications, to communicate with you about our services and to inform you of our updated policies and terms. We also use your information to respond to you when you contact us.

Display and measure advertisements and services: We use the information we have to improve the advertising and measurement system so that we can show you relevant ads on and outside of our services and measure the reach and effectiveness of the ads and services.

Promote security and safety: We use the information we have to help verify accounts and activity, and to promote security and safety within or outside our services, such as by investigating suspicious activity or violations of our terms or policies. We work hard to protect your account using a team of engineers, automated systems, and advanced technologies such as encryption and machine learning. We also offer easy-to-use security tools that add an extra level of security to your account.

We use cookies and similar technologies to provide and support our services and each use is described and clarified in this part of our policy.

Vendors, service providers and other partners: We transfer information to vendors, service providers, and other partners who support our business worldwide, such as providing technical infrastructure services, analyzing how our services are used, advertising and Measuring the effectiveness of services, providing customer service, facilitating payments, or conducting educational research and surveys. These partners must comply with such privacy obligations in accordance with this data policy and the agreements that have been entered into between us.

  1. How can I manage or delete information about me? 

We store data as long as it is needed to provide products and services to the people mentioned above, including you and others. Information associated with your account will be retained until your account is deleted, unless we require data to provide products and services.

You can delete your account at any time. Also, you can request your account to be deleted by emailing your account details to support@tasdeeq.org. When you delete your account, we delete your published items, such as your photos. If you don’t want to delete your account, but want to temporarily stop using Tasdeeq, you can deactivate your account instead. Remember that information shared by others about you is not part of your account and will not be deleted if your account is deleted

  1. Retaining the Data We Collect

We will retain your information until you cancel your account in the Application.

  1. How do we respond to legal requests or prevent damages?

We may access, secure and share your information in response to a legal request (such as a LEA request, search warrant, court order or summons), if we believe in good faith that we are legally required to do so. This may include responding to legal requests from LEAs across Pakistan, where we believe in good faith that it is legally necessary to respond within this jurisdiction, affecting consumers within this jurisdiction. Yes, smooth with internationally recognized standards. Also, when we sincerely believe that information is necessary for these things, we can access it, store it and share it: To detect and deal with fraud or other illegal activity; To protect our own, yours and others; To be included as part of the investigation; Or to prevent death or inevitable bodily harm. For example, we may provide information to third party partners about the credibility of your account to prevent fraud and misuse on and off our Services. When subject to a legal request or liability, a government investigation or an investigation into possible violations of our Terms or Policies or otherwise purchases made with Tasdeeq to prevent loss of financial transaction data. We used to encrypt the user’s critical details before storing in our database. We do not guarantee the security of our database nor can we guarantee that the information you have provided will not be intercepted while being transmitted to us. Any transmission of information by you to us is at your own risk. You must not disclose your private information to anyone. As effective as technology is, no security system is impenetrable.

We may amend this Privacy Policy to reflect changes in our practices. If we do so, we will inform you via email or by means of a notice on the Website 24 hours before the change becomes effective.   • You shall not use any Platform Content/database for any purpose other than as an employer seeking to verify a worker, including but not limited to using the information in the information database to sell or promote any products or services.

Vendors, service providers and other partners: We transfer information to vendors, service providers, and other partners who support our business worldwide, such as providing technical infrastructure services, analyzing how our services are used, advertising and Measuring the effectiveness of services, providing customer service, facilitating payments, or conducting educational research and surveys. These partners must comply with such privacy obligations in accordance with this data policy and the agreements that have been entered into between us.

  1. How can I manage or delete information about me? 

We store data as long as it is needed to provide products and services to the people mentioned above, including you and others. Information associated with your account will be retained until your account is deleted, unless we require data to provide products and services.

You can delete your account at any time. Also, you can request your account to be deleted by emailing your account details to support@tapp.pk. When you delete your account, we delete your published items, such as your photos. If you don’t want to delete your account, but want to temporarily stop using TApp, you can deactivate your account instead. Remember that information shared by others about you is not part of your account and will not be deleted if your account is deleted

  1. Retaining the Data We Collect

We will retain your information until you cancel your account in the Application.

  1. How do we respond to legal requests or prevent damages?

We may access, secure and share your information in response to a legal request (such as a LEA request, search warrant, court order or summons), if we believe in good faith that we are legally required to do so. This may include responding to legal requests from LEAs across Pakistan, where we believe in good faith that it is legally necessary to respond within this jurisdiction, affecting consumers within this jurisdiction. Yes, smooth with internationally recognized standards. Also, when we sincerely believe that information is necessary for these things, we can access it, store it and share it: To detect and deal with fraud or other illegal activity; To protect our own, yours and others; To be included as part of the investigation; Or to prevent death or inevitable bodily harm. For example, we may provide information to third party partners about the credibility of your account to prevent fraud and misuse on and off our Services. When subject to a legal request or liability, a government investigation or an investigation into possible violations of our Terms or Policies or otherwise purchases made with TApp to prevent loss of financial transaction data. Including, the information we receive about you may be accessed, processed and retained for extended periods. Prevent reuse or other violations of our Terms

  1. Security

We used to encrypt the user’s critical details before storing in our database. We do not guarantee the security of our database nor can we guarantee that the information you have provided will not be intercepted while being transmitted to us. Any transmission of information by you to us is at your own risk. You must not disclose your private information to anyone. As effective as technology is, no security system is impenetrable.

We may amend this Privacy Policy to reflect changes in our practices. If we do so, we will inform you via email or by means of a notice on the Website 24 hours before the change becomes effective. We encourage you to periodically review this page for the latest information on our privacy practices.

TAPP SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, LOST DATA IN CONNECTION WITH, OR OTHERWISE RESULTING FROM ANY OF ITS ACTS OR OMISSIONS IN CONNECTION WITH THIS PRIVACY POLICY.

These Terms of Use, together with our Privacy Policy, Copyright Guidelines, Disclaimer & Disclosures Policy and any other Terms of Use or Guidelines connected with the use of the Platform, constitute a legally binding agreement (the “Agreement”) between You and the Platform in relation to Your use of the Services. This Agreement is an electronic record in terms of the local applicable laws and generated by a computer system and does not require any physical or digital signatures.

Definitions

  • “Company, We, Us and Our” shall refer to TApp.
  • “Customer” refers to individuals (Employers) who engage with the Platform for connecting with & registering full and part-time workers who are seeking work opportunities at a local level.
  • “Worker” refers to Individuals (Domestic servants/Blue Collar Labor) who have engaged themselves with the Customers and offer their services on a full or part-time basis, either as permanent or temporary hire in return for a monthly salary or wages as per their services offered to the Customer. It shall refer in person to the individuals who are employed as workers, such as Maids, Cooks, Security Guards, Electricians, Babysitters, Drivers, Delivery Boys, Peons, or any other kind of Unorganized Worker added on the Platform from time to time.
  • “Service” or “Services” shall refer to all the Services provided on the Platform for the Customer as well as the Worker.
  • “You”, “Yourself/Yourselves” and “You’re” shall mean both the Customer as well as the Worker who is entering into this agreement with TApp through the Platform.
  • “Platform” shall refer to TApp, the Website and the Mobile Applications (iOS & Android) and also interchangeably.
  • Acceptance of Terms of Use
  • Please read these Terms of Use very carefully.
We reserve the right to change, alter, replace or otherwise modify these Terms of Use at any time. Therefore, we encourage you to review these Terms of Use regularly for any changes. The date of the last modification is stated at the end of these Terms of Use.

Description and Use of the Platform

  • We aim at providing a technology-led Platform for helping secure households & communities by electronically registering the Workers against their CNIC. The Platform acts as a connecting point/intermediary for NADRA/Police verification, through the registered CNIC number. The Platform allows Customers to connect with potential Workers and view their comments/feedback through their digitized extensive records.
  • The Company operating the Platform is not an Agency, Agent or Contractor of the Customers or the Workers in any way. The Platform is not providing a liaison service for such Workers to the Customer. The Workers and the Platform do not share any Employer-Employee relationship. The actual services provided are to the Customers who will then be provided with the complete verification of the Workers; the Workers, in turn, will be able to maintain a proper record therefore, subjected to a separate relationship between the Worker and the Customer. The Platform or the Company shall under no circumstances be a party to that relationship. The Platform claims NO responsibility/liability in respect of the Worker, including but not limited to any claims of employment or any vicarious liability arising out of the Service or otherwise.
  • It is your responsibility to ensure that You have downloaded the correct Mobile Application for your device. It is also Your responsibility to ensure that Your device is compatible with the Mobile Application. The Company claims NO responsibility/liability if you do not have a compatible mobile device or if you download the wrong version of the Mobile Application for your device.

By using the services of the Platform, you further agree that:

  • You will use our Services for your sole, personal use and will not resell our Services to a third party;
  • You will not assign or transfer your account to any other person/legal entity;
  • You will not use our services for unlawful or fraudulent purposes;
  • You will keep your account password secure and confidential;
  • You will follow/abide by the applicable laws of Pakistan.
  • The Company claims NO responsibility/liability of any nature arising out of a breach of any of the above-mentioned covenants.
  • The Company reserves the right to terminate the use of the Platform and your account immediately, should you not comply with the abovementioned covenants.
  • The Platform, may, from time to time, release new tools and resources on the Website, release new versions of the Apps, or introduce other services and/or features for the Platform. Any new services and features will be subject to these Terms of Use as well as any additional terms of use that we may release for those specific services or features.
  • We appreciate hearing from You and welcome Your comments regarding our Services and the Platform. Please be advised, however, that our policy does not permit us to accept or consider creative ideas, suggestions, inventions or materials other than those which we have specifically requested. While we do value your feedback on our Services, please be specific in your comments regarding our Services and do not submit creative ideas, inventions, suggestions, or materials. If, despite our request, you send us creative suggestions, ideas, drawings, concepts, inventions, or other information the same shall be the property of the Company. None of the submissions shall be subject to any obligation of confidentiality on our part and we shall not be liable for any use or disclosure of any submission. The Company shall own exclusively all now-known or later discovered rights to the submission and shall be entitled to unrestricted use of the submission for any purpose whatsoever, commercial or otherwise, without compensation to you or any other person who submitted the submission.
  • The information made available on the Platform is for the information/employment search and You shall not use the same for any other purpose than your personal. The information and database and other features of the Platform may be used by the Customers only for the purpose of verification by self or own company.
  • You shall not use any Platform Content/database for any purpose other than as an employer seeking to verify a worker, including but not limited to using the information in the information database to sell or promote any products or services.

‘TASDEEQ’ Account- Registration and Password

  • You are not obliged to register, however, access to Services is only available to registered Customers and their Workers. When you register to verify a Worker or assess their records through the Platform, you will provide us with your Contact Number and Full Name, which will, amongst other verification processes, could generate an OTP directed to your Contact Number so that we ensure that the Contact Number that you provide is, and remains valid. An alternative method could be used in its place also. Your Contact Number and any other information you chose to provide about yourself will be treated in accordance with our Privacy Policy. In addition to the Terms of Use and Privacy Policy, the Company may disclose to third parties on an anonymous basis, certain aggregate information contained in your registration application. Subject to the Terms of Use herein, the Company will not disclose to any third party your name, or telephone number without your prior consent, except to the extent necessary or appropriate to comply with applicable laws or in legal proceedings where such information is relevant.
  • Customers are solely responsible for the postings by them on the Platform. The Platform is not to be considered to be an employer, but just a tool, by the Customer, and the Company/Platform claims NO responsibility/liability or be responsible for any employment decisions, for whatever reason, made by any entity posting feedback of the Workers on the Platform.
  • You may terminate your account at any time as described in the Termination section below. You understand and acknowledge that if you cancel your Customer account or your Customer account is terminated, all your account information from the Platform, including saved information, network contacts, and given feedback, will be marked as deleted in and may be deleted from the Platform’s databases. Information may continue to be available for some period of time because of delays in propagating such deletion through the Platform’s servers. You further understand and acknowledge, upon the termination of the Customer account, the Platform shall have no obligation or responsibility to return your account information, and you agree and undertake not to have/make any claims for such account information.
  • You shall use the Platform information database in accordance with all applicable privacy and data protection laws, and you agree that you shall not further disclose any of the data from the Platform information database to any third party
  • You are solely responsible for maintaining the confidentiality and security of your username and password, and You will remain responsible and liable for all use of your username and password, and all activity emanating from Your account, whether or not such activity was authorized by you.
  • If your username or password is lost or stolen, or if you believe that your account has been accessed by unauthorized third parties, you are advised to notify the Platform in writing and should be careful of exposing the OTP to others.
  • We reserve the right to disallow, cancel, remove or reassign certain usernames and permalinks in appropriate circumstances, as determined by us in our sole discretion, and may, with or without prior notice, suspend or terminate Your account if activities occur on that account which, in our sole discretion, would or might constitute a violation of these Terms of Use or violation of the rights of any third party, or of any applicable laws or regulations.

The Company is not a party to any Service contract

Each Customer and Worker hereby acknowledges and agrees that the Company/Platform is NOT a party to any oral or written Agreement for Service or any contract entered into between the Customer and the Worker in connection with any Service offered, directly or indirectly, through the Platform, nor is the Platform responsible for any crime committed by the Workers that the Customer hires. The Customer and the Worker acknowledge, agree and understand that the Platform only seeks to provide a platform wherein the Service User and Service Professional can be brought together, and the Platform itself has no role in the execution or provision of Services.

Customer’s Guidelines

  • The Company and the Platform are neither an Agency, Agent or Contractor nor it is a Job portal for Workers or the Customer.
  • The Platform simply helps the Customer verify their Workers through a proper channel, and get access to the feedback given to other Workers of respective categories that the Customer is looking for on the Platform. Beyond providing the Contact & Basic Profile Details, along with the verification of the Worker, the Platform does not provide any other Service whatsoever. Once the details are shared, the Platform does not carry any obligation nor assumes any liability with respect to ensuring that the Customer and the selected Worker meet, talk and conduct any discussions or are engaged or hired by the Customer.
  • The Customer shall only be provided with the names, contact details, feedback by other Customers, a relative rating (based on experience, reliability, etc.), and brief work-related information of the potential Worker selected by them in the area where they are located. The eventual selection and hiring process of such a Worker is between the Customer and the Worker separately. The salary/fee to be charged by the Worker is to be decided solely between the Customer and the Worker, without any interference/suggestion by the Platform.
  • The Company and the Platform shall not take any portion of the salary/fee determined between the Customer and the Worker, in case You select one from the list provided by the Platform.
  • The Platform acts as a connecting point/intermediary for Police/CPLC verification, through the registered CNIC number, Picture and CNIC Images. The Platform allows Customers to connect with potential Workers and view their comments/feedback/ratings through their digitized extensive records.
  • Customers are recommended and responsible for conducting their own Background Checks and Self-Verification and registering with the local police station, on the Worker they would be finally selecting and taking the final call on hiring the right person for the work. This platform is an assisting tool and is in no way a replacement to the local laws of the land. The Company/Platform takes no responsibility for the verified information of the Worker coming in from the Police/CPLC as this information is directly relayed to the Customers/Users without any interference/changes from the company/platform. If any discrepancy is detected by the Customers/Users, they should contact these LEAs.
  • Consent of Worker: At the time of registration, it is the responsibility of the employer to take consent from the worker, that is before taking the picture of the worker seeking employment if he/she allows the employer to place a request with the platform to retrieve any information which might be present, including previous work history or check for any criminal background. This consent needs to be recorded by the employer in paper or electronic form.
  • The Company captures the CNIC details and mobile numbers (i.e. Contact details) of the Worker as provided by the Customer. The Company and the Platform are not liable to the Customer for any loss that the Customer suffers if any Worker changes their contact details after initially connecting with the Customer, either through phone or in person. Once the Customer connects with the Worker in any manner whatsoever, the relationship is solely between the Customer and the Worker; and the Company and the Platform are not connected with further transactions in any manner.
  • It is the sole discretion of the Worker to join the Customer’s Domestic or Workplace environment upon selection. Likewise, it is the sole discretion of the Customer to hire the Worker who he/she finds suitable enough for the work at hand. It is the sole discretion of the worker to provide his/her CNIC information & other contact information to the customer, which on the consent of the worker taken by the customer, is to be shared with the Company/Platform. The Company never influences any Worker to accept the offer of the Customer. In the same way, the Company never influences any Customer to hire any particular Worker.
  • In addition to the foregoing, there are risks, including but not limited to the risk of physical harm, from dealing with strangers, foreign nationals, underage persons or people acting under false pretences. The Customer/User assumes all risks associated with dealing with Workers with whom they come in contact through the Platform. By its very nature other people’s information may be offensive, harmful or inaccurate, and in some cases may be mislabeled or deceptively labelled. We expect that you will use caution and common sense when using the Platform, notwithstanding the efforts and endeavours that are undertaken by the Platform to protect your interest.
  • The content may contain inaccuracies or typographical errors. The Company makes no representations about the accuracy, reliability, completeness, or timeliness of the Platform. The use of all content on the Platform is at the Customer/User’s own risk. The Company cannot guarantee and does not promise any specific results from the use of the Platform. No advice or information, whether oral or written, obtained by a user from the Platform or through or from the Platform shall create any warranty not expressly stated herein.
  • Customer/User acknowledges and agrees that they are solely responsible for the form, content and accuracy of any information or material contained therein placed by you on the Platform. The Customer is solely responsible for their postings on the Platform. The Company is not to be considered to be an employer with respect to your use of the Platform and the Company shall not be responsible for any employment decisions, for whatever reason made, made by any entity posting jobs on the Platform.
  • The Company encourages you to keep a backup copy of any of your user content. To the extent permitted by law, in no event shall the company be liable for the deletion, loss, or unauthorized modification of any user content.
  • The Platform is not responsible for any monetary or consequential loss or damage caused to the Customer if the Worker refuses to join the Customer after initial discussion or leaves the engagement or employment if any made.
  • It is the Customer’s responsibility to exercise caution while using the services of the Worker that has been selected using the Platform. In case the Worker is negligent in his/her performance, is intoxicated, violates the law or does anything contrary to the law and general norms of service, it will be between the Customer and the Worker to sort out the dispute. The Company and the Platform shall not be held liable for the Worker’s behaviour in any manner whatsoever. However, the Company shall register your complaint, if you choose to email support@tapp.pk to lodge a complaint. The Company shall conduct an internal investigation into such a matter at its own end, and in the case of the Worker’s fault, the Company will not allow the Worker to be listed on its Platform anymore.
  • The Customer shall not hold the Company and the Platform and any of its Partners or employees responsible for the character of the Worker who they might have selected from the list of contacts provided by the Platform.
  • The Customer shall not hold the Company and the Platform and any of its Partners or employees responsible for any unforeseen/illegal activities committed by the selected Worker (for e.g., theft/heinous offence/murder, etc.)
  • The Customer agrees that the Information provided by him/her to the Company will always be true, accurate, correct, complete and up to date, to the best of your knowledge. User agrees that the necessary details provided by the Customer to connect with the Workers are true, accurate, correct, and complete and shall ensure to keep it up to date, in case of any change.
  • The Customer must be 18 years of age or older to register, use the Services or visit the Website in any manner. By registering, or accepting this Agreement, You represent and warrant to the Company that You are 18 years of age or older, and that You have the right, authority and capacity to subscribe for and use the Services available through the Platform and agree to and abide by these Terms of Use. You also represent and warrant that you are not a person barred from receiving the Services under the laws of Pakistan or other countries.

Prohibitions

The Customer and the Worker are prohibited from:

  • Violating or attempting to violate the integrity or security of the Services or any of Platform’s software;
  • Transmitting any information (including messages and hyperlinks) on or through the Services that is disruptive or competitive to the provision of Services by the Company;
  • Intentionally submitting on the Services any incomplete, false or inaccurate information;
  • Making any unsolicited communications to other Users;
  • Using any engine, software, tools, agent or other device or mechanism (such as spiders, robots, avatars or intelligent agents) to navigate or search the Service;
  • Attempting to decipher, decompile, disassemble or reverse engineer any part of the Services unless explicitly permitted by Platform;
  • Copying or duplicating in any manner any of the Platform content or other information available from the Service;
  • Framing or hotlinking or deep-linking any Platform content; and
  • Circumventing or disabling any digital rights management, usage rules, or other security features of the software.

Limitation of Liability

  • To the extent permitted by law, the Company will not be liable for any indirect or consequential loss or damage to You (including without limitation loss of business, opportunity, data, or profits) arising out of or in connection with the use of the Platform. You agree that even in case of any court case filed by them in any court of law in Pakistan, the maximum liability of the Company shall not exceed the amount of money paid by the Customer to the Platform in connection to taking its Service.
  • The Company takes no responsibility for the quality of Service of the Worker requested by the Customer through the Platform. The quality of the Service is entirely the responsibility of the Worker who has been finally selected by the Customer, in accordance with the verification and feedback that the Company provided. The Company does not take any liability in connection with the Service provided by the Worker including but not limited to the acts, actions, behaviour, conduct, and/or negligence on the part of the Worker.
  • Force Majeure: The Company shall not be held liable for any failure or delay in the performance of Services by the Help where such failure arises as a result of any act or omission, which is outside our reasonable control such as unprecedented circumstances, overwhelming and unpreventable events caused directly and exclusively by the forces of nature that can be neither anticipated, nor controlled, nor prevented by the exercise of prudence, diligence, and care, including but not limited to war, riot, civil commotion; compliance with any law or governmental order, rule, regulation or direction and acts of third parties.
  • Taxes: You understand that we act solely as an intermediary between a Customer and the Worker. Because state and local tax laws vary significantly by locality, you understand and agree that you are solely responsible for determining your own tax reporting requirements in consultation with tax advisors and that we cannot and do not offer tax advice to either Customer or Worker. Further, you understand that the Company shall not be responsible or liable in any manner in relation to the tax liability of a Customer or a Worker.
  • Indemnity: The Customer/Worker agrees to indemnify and hold the Company and its Partners, employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against the Company arising out of any breach by the Customer or the selected Worker/Customer through the Platform or any other liabilities arising out of the Customer’s use of the Platform.
  • Severance: If any of these Terms of Use should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, then such Term or Condition shall be severed, and the remaining Terms of Use shall survive and remain in full force and effect and continue to be binding and enforceable.
  • Waiver: If you breach these Terms of Use and we take no action, we will still be entitled to use our rights and remedies in any other situation where you breach these Terms of Use.
  • Assignment: The Customer and the Worker may not assign or sub-license the rights, duties or obligations under these Terms of Use, in whole or in part, to any person or entity without the prior written permission of the Company.
  • No Warranties: You agree that this Platform (including the website) is only for the verification of the employees and for employers to showcase their need for hiring an employee as per their requirement by posting on available jobs. We do not specifically recommend any particular employee. It shall be the responsibility of the Customer to assess the experience and skills of the Workers whose profiles are posted on the Platform. Though we endeavour to verify basic information about the employees, we do not warrant or confirm the nature of the skills and experience the employees may possess, the truth or accuracy of the information provided by employees, or the ability of employees to perform the given tasks.
    There are risks, including but not limited to the risk of physical harm, dealing with strangers, or people acting under false pretences. The Customer and the Workers assume all risks associated with dealing with other users with whom you come in contact through the Platform.
  • Hackers: It is possible that other users (including unauthorized users or “hackers”) may post or transmit offensive or obscene materials on the Platform and that You may be involuntarily exposed to such offensive and obscene materials. We do not approve of such unauthorized use or acts.
    You acknowledge and agree that we are not responsible for the use of any personal information that you publicly disclose or share with others on the Platform. Please carefully select the type of information that you publicly disclose or share with others on the Platform.
  • Promotions/Events: The Company and the Platform may, at its sole discretion, come up with additional terms which may apply to certain Services. These terms may be established with regard to a particular event, activity or promotion, and such additional terms will be disclosed to you in connection with the applicable services. These additional Terms and Conditions are in addition to and therefore shall be deemed to be a part of, the original Terms and Conditions for the purposes of the applicable services. The additional terms shall prevail over the existing Terms and Conditions in the event of any conflict with respect to the applicable services.

Termination

You may terminate this Agreement at any time by sending a notice in writing to TApp at support@tapp.pk, by asking the Company to remove all of your Content from your account, and by deleting your account and thereafter by ceasing to use the Platform.

The Company reserves the right to terminate the Service and your use of the Platform, if:

  • You have been using the Service or Application with an incompatible or unauthorized device;
  • You have violated any clause of these Terms of Use, Privacy Policy or Copyright Policy;
  • You have misused, abused or interfered with the use of the Platform. Misuse includes creating multiple or false profiles, or try to falsely interfere with the rating system, or try to corrupt the system’s integrity in any way, trying to infringe any intellectual property rights, violating any of the terms and conditions of these Terms of Use, or any other behaviour that the Company, in its sole discretion, deems contrary to its purpose;
  • The Platform has a reasonable reason to do so, at its sole discretion.

In the event of termination by you or by the Platform, your account will be disabled and you shall not be granted access to the Platform for availing our Services. You will not be able to access our content unless you create another account with the Platform, with the consent of the Company.
The Terms of Use shall remain in full force and effect while you continue to have an account with us. Certain provisions of the Terms and Conditions shall remain in effect, even after Termination, including but not limited to, Intellectual Property and Indemnification.
Notwithstanding the termination, you shall continue to be bound by the terms of this Agreement in respect of your prior use of this Platform and all matters connected with, relating to or arising from such use

  • In effect and Last Update: The Terms of Use are in effect from the day of the availability of the app to the General Public through Google & Apple App Stores.

Disclaimers & Disclosures Policy

  • Safe Pakistan Welfare Trust (SPWT) is a Government Registered Tax-Exempt Non-Profit Organization.
  • It’s important to understand the limitations of the Platform before using it, with special reference to the background check being conducted and displayed on this platform:
    • The system does NOT perform a NADRA verification. Hence, it is very important for the Employers to first authenticate the worker’s CNIC information being submitted of their workers into the Platform using NADRA SMS 7000 service. (https://www.nadra.gov.pk/local-projects/identity-management/sms-services-7000-8400-8300-8500/)
      • This step is very important to check against FAKE CNIC numbers. Workers sometimes hide their true identity.
      • The Employers are required to first check the authenticity of the CNIC data by transmitting through text message the CNIC number of the workers to 7000 SMS NADRA SERVICE. Standard SMS charges will apply.
      • NADRA will transmit back the name against the CNIC number as well as the person’s father’s name. This step will ensure that the Employer is submitting the correct CNIC number of the person they are hiring.     • This platform will transmit the NADRA-issued CNIC information to Police and Citizens Police Liaison Committee (CPLC).
    • The TApp platform is connected to the Police through a live API connection. Police are solely responsible for the authenticity of the data. The information being relayed & displayed through the TApp platform with regard to the criminal background check is being displayed at the TApp end without any human intervention.
    • The Citizens Police Liaison Committee (CPLC) maintains the digitalized FIRs information that has been filed with Police stations since 1987 (http://www.cplc.org.pk/2015/11/04/fir-database).
    • Employers need to ensure that they obtain either written or video consent from their workers before submitting their CNIC for background criminal checks.
    • Police FIRs filed all over Pakistan has their inherent limitations, such as (a) CNIC may not be mentioned in some FIRs, (b) Some FIRs may only have first name or name entered with different spellings, (c) FIRs are mostly filed in Urdu or local vernacular language, (d) Some FIRs may have been filed against “unknown people”.
    • In other words, a person may have an FIR filed against him/her but if a CNIC may not be mentioned on that FIR, he/she may evade detection. The same may be true in terms of the spelling of the name, which may be different from Urdu to English. An example is “Mohammad” vs “Muhammad”, “Ahmad” vs “Ahmed”, etc.
    • Simply filing an FIR against a person does not mean criminal activity or that a person may be a criminal. A crime is only confirmed against any person by a Court of Law upon conviction at the end of a trial.
    • Furthermore, the information entered into the platform (web interface) is a manual process. Hence, the displayed information is subject to human errors at the data entry level.
    • TApp is not responsible for any background information. It is only a conduit.

This Privacy Policy, together with our Terms of Use, Copyright Guidelines, Disclaimer Policy and any other Terms of Use or Guidelines connected with the use of the Platform, constitute a legally binding agreement (the “Agreement”) between You and TApp (“the Platform”) in relation to your use of the Services. This Privacy Policy governs the Platform’s privacy practices with respect to the protection of the personal and financial information that you submit or that we collect to offer the desired service to you. The Platform is owned and operated by TApp.

The Platform is concerned about the privacy of the Customers and has provided this Privacy Policy to familiarize you with the manner in which the Platform collects, uses, stores, discloses and transfers Your Personal Information (as defined below) collected through the Website. “Worker” shall refer to the same meaning as present in the Terms of Use.

Information we collect

The Platform seeks to provide the Customers with information details of prospective nearest Workers located in the vicinity of the Customer’s Search location. For the aforementioned to be possible, it is essential for the Platform to collect and use certain information from the Customers. The Platform may collect Personal Identification information as well as non-personal identification information from the Customers.
The personal identification information includes, but it not limited to, your email address, name, telephone number, access to your location, your contacts & your album folder and other appropriate details that would help the Platform in ensuring you get connected with the nearest Workers around your search locality and avail all the services being offered by the Platform, and also in verifying your Identity, to make sure someone else doesn’t use the platform in your place. This information is collected by the Platform only if they are submitted by the Customers & allowed access by the Customers. The objective behind collecting your personal information is to provide the services you are seeking and to perform various site-related activities with greater convenience and efficiency when you place an order. The Platform may collect personal identification information in order to register Customers on the Platform, keep a record of the services sought by the Customers and for performing other website-related activities which help the platform in serving you better. Due to the nature of the services provided by the Website/App, the Platform may disclose your personal information to third parties, with your explicit consent, in order to provide you with the best information for which you accessed the Platform’s services.
The Platform may also disclose information in response to a court order or government/police request, or when it would be reasonably necessary to disclose the said information to protect the rights of the Platform, third parties, or the public at large. The Platform may disclose information to comply with legal processes, to enforce its Terms of Use, to protect its Operations and rights, privacy and safety of the properties and to pursue any available legal remedies.

If you decide to avail of our services on the Website, we collect some additional information in order to complete the transaction. The Platform aims at easing out the process of finding the prospective Worker for a Customer’s Domestic or Workplace environment, as well as his or her feedback and comments by the previous owner.

By using the Platform and as per the safety and security guidelines of TApp, You confirm to take the responsibility of ensuring the safety measures mentioned herein at your risk.

  • Professional Background Verification of Workers: Don’t forget to get the Background Verification done for the Worker who you have hired.
  • Be 100% Sure: Do not give anyone entry into your House or Workplace unless you are 100% sure they are the ones who you are finally going to hire and pay.
  • Limited Personal Information: Do not provide any non-work-related personal information about yourself or your family or your office.
  • Check legitimacy before monetary transactions: Be careful when engaging in any monetary transactions with any stranger. Initiate the transaction only when you are sure of the Worker who you are dealing with.
